ZYVZEN ("we," "us," or "our") provides digital architecture, web development, mobile application development, design, and related technology services. These Terms constitute a legally binding agreement between you and ZYVZEN.

For projects completed under a service agreement:

  • Work product and deliverables are transferred to the client upon full payment, as specified in the individual service agreement
  • ZYVZEN retains the right to use project work for portfolio and marketing purposes, unless otherwise specified in writing
  • Third-party assets, libraries, and frameworks remain subject to their respective licenses

You may not reproduce, distribute, modify, or create derivative works from our intellectual property without explicit written permission.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZYVZEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to our services shall not exceed the total amount paid by you to ZYVZEN in the twelve (12) months preceding the event giving rise to the claim.

We provide services "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ZYVZEN operates, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our services shall be resolved through binding arbitration or in the appropriate courts of the governing jurisdiction, as mutually agreed upon.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
